民政部等七部門近日聯(lián)合發(fā)布關(guān)于加強養(yǎng)老機構(gòu)預(yù)收費監(jiān)管的指導(dǎo)意見，鼓勵養(yǎng)老機構(gòu)采用當月收取費用的方式，并規(guī)定養(yǎng)老服務(wù)費預(yù)收的周期最長不得超過12個月。

A guideline on regulating prepayment for elderly care services has been issued by the Ministry of Civil Affairs and six other departments lately. The guideline encourages providing elderly care services through monthly payment. When prepayment is involved, it says, the maximum prepayment period for elderly service fees should not exceed 12 months.

【知識點】

養(yǎng)老機構(gòu)預(yù)收費是指養(yǎng)老機構(gòu)提前向老年人或者其代理人收取一定額度費用，并承諾在一定時間內(nèi)，按照服務(wù)協(xié)議約定提供相應(yīng)養(yǎng)老服務(wù)的行為。養(yǎng)老機構(gòu)預(yù)收的費用主要包括養(yǎng)老服務(wù)費、押金和會員費。養(yǎng)老服務(wù)費是指床位費、照料護理費、餐費等費用；押金是指為老年人就醫(yī)等應(yīng)急需要、償還拖欠費用、賠償財物損失等作擔保的費用；會員費是指養(yǎng)老機構(gòu)以“會員卡”“貴賓卡”等形式收取的，用于老年人獲得服務(wù)資格、使用設(shè)施設(shè)備、享受服務(wù)優(yōu)惠等的費用。

近年來，一些養(yǎng)老機構(gòu)采取預(yù)收費方式運營，一定程度緩解了設(shè)施建設(shè)資金不足等問題，紓解了運營壓力。但是，也有少數(shù)養(yǎng)老機構(gòu)出現(xiàn)了資金管理使用不規(guī)范，資金鏈斷裂后“退費難”“爆雷”“跑路”等問題，甚至有的不法分子實施非法集資、詐騙等犯罪行為，嚴重損害老年人合法權(quán)益，擾亂養(yǎng)老服務(wù)市場秩序。

為此，民政部、國家發(fā)展改革委、公安部、財政部、中國人民銀行、市場監(jiān)管總局、金融監(jiān)管總局聯(lián)合發(fā)布關(guān)于加強養(yǎng)老機構(gòu)預(yù)收費監(jiān)管的指導(dǎo)意見，自2024年10月1日起施行，有效期5年。其中提到，主要目標是，2025年前，建立健全跨部門養(yǎng)老機構(gòu)預(yù)收費監(jiān)管工作機制，協(xié)同監(jiān)管進一步優(yōu)化，預(yù)收費資金監(jiān)測預(yù)警、風(fēng)險隱患排查和違法違規(guī)行為的處置能力有效提升，養(yǎng)老服務(wù)市場更加公平有序，非法集資風(fēng)險隱患有效減少，老年人對養(yǎng)老服務(wù)消費的滿意度穩(wěn)步提高。
